About the Newton County Jail & Sheriff

Newton County is situated in the easternmost part of Texas. As of the 2020 census, it had a population of 12,217. Currently, the county holds 12 inmates, but there are plans to establish a new jail in 2023, which will serve as the Newton County Law Enforcement Center and justice center.

For the safety and security of jail personnel and inmates, certain measures are in place:

  1. All items brought into the facility's security perimeter undergo thorough searches for contraband.
  2. Inmates leaving the security perimeter are subject to comprehensive contraband searches before reentering.
  3. Regular and random searches of the entire facility are conducted to detect and document contraband. These searches are noted in a permanent facility record.
  4. Searches for contraband are conducted at unpredictable intervals to prevent anticipation by inmates.

When inmates are outside the security perimeter in court holding cells, they are observed by a peace officer, a Texas Commission on Law Enforcement-licensed jailer, or a bailiff. The sheriff or operator of the facility has established procedures to ensure face-to-face observation of all inmates at least once every 30 minutes. Each floor housing 10 or more inmates must have a minimum of one jailer, licensed peace officer, or bailiff present for direct inmate supervision. For every 48 inmates or increment thereof on each floor, an additional jailer, licensed peace officer, or bailiff is provided. There should be continuous two-way voice communication capability between inmates and jailers, licensed peace officers, or bailiffs at all times, as required. Closed circuit television may be utilized, but it does not replace the mandatory personal observation requirements.

What happens during booking in Newton County?

After being arrested and taken into custody, and after being read their Miranda Rights, an offender will next be transported to the local police or department or the Sheriff’s Department in Newton County for booking.

Booking is very involved and requires multiple steps in the process, however, keep in mind that most attorneys will advise that an offender remain silent and not offer any additional information about the crime they have been arrested for because anything they do say may be recorded and may very well be used against them in court.

The arresting jurisdiction will ask about gang affiliations, tattoos, medical conditions, prescribed medication they are taking, recreational drugs they are on or addicted to, allergies, if they are suicidal, and other relevant information that will help with determining their cell assignment and special needs.

What happens to an offender’s personal property during booking?

During the arrest and booking process an offender will also have all their personal property confiscated and held for either their release from jail, or with the offender’s approval, released to a friend or family member.

Personal property includes the clothing they are wearing, money, wallets, purses, cell phones, jewelry, body rings, earrings, watches, and even glasses if they are deemed a security risk. If they are allowed to keep their shoes or sneakers, the laces are removed.

What happens after booking?

At this point the offender will be allowed to make a free phone call to a person of their choice to notify them of their arrest, and/or arrange a bond or bail for their release.

If the offender is being detained and housed while awaiting arraignment, the Newton County Jail & Sheriff will provide a jail garment and slip-on shoes, a blanket, sheets, soap, toothbrush, toothpaste, and a towel.

Often, before they are dressed in the jail outfit and brought to their housing location, they will be forced to take a shower and undergo a disinfectant treatment for body and hair lice, scabies or other pests that may be residing on their person.
